This Privacy Policy describes how ballerinagifts.com (the “Site” or “we”) collects, uses, and discloses your Personal Information when you visit or make a purchase from the Site.

Collecting Personal Information

When you visit the Site, we collect certain information about your device, your interaction with the Site, and information necessary to process your purchases. We may also collect additional information if you contact us for customer support. In this Privacy Policy, we refer to any information that can uniquely identify an individual (including the information below) as “Personal Information”. We use Shopify to power our online store. We have enabled "Limit tracking for customers in Europe" in our Shopify store settings. This feature limits Shopify’s tracking of European visitors (as determined by the IP address you transmit to the Site) to our online store. Shopify limits customer tracking by downgrading its own non-essential cookies, outlined in the Cookies section on this page below, to session cookies. Session cookies are generally deleted when a visitor closes his/her browser. If a European customer consents to tracking, then the non-essential cookies are upgraded to persistent cookies, which are not deleted when the visitor closes his/her browser.

Furthermore, for all visitors regardless of geographic origin (according to the IP address you transmit to the Site), we have installed a cookie notice banner that requires users of the Site to explicitly consent to "Accept all" alternatively "Only accept essential cookies". You can change your selection at any time by clicking the small "fingerprint" icon displayed at the left edge of every page of the Site.

Order information

  • Examples of Personal Information collected: name, billing address, shipping address, payment information (including credit card numbers, PayPal, Apple Pay, Google Pay), email address, and phone number.
  • Purpose of collection: to provide products or services to you to fulfill our contract, to process your payment information, arrange for shipping, and provide you with invoices and/or order confirmations, communicate with you, screen our orders for potential risk or fraud, and when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
  • Source of collection: collected from you.
  • Disclosure for a business purpose: shared with our processor Shopify, shipping services provider ShipStation, and carriers including the USPS, UPS, and FedEx.

Customer support information

  • Examples of Personal Information collected: name, billing address, shipping address, payment information (including credit card numbers, or PayPal, Apple Pay, and Google Pay account related), email address, and phone number.
  • Purpose of collection: to provide customer support.
  • Source of collection: collected from you.
  • Disclosure for a business purpose: no disclosures.

Minors

The Site is not intended for individuals under the age of 13 years. We do not intentionally collect Personal Information from children. If you are the parent or guardian and believe your child has provided us with Personal Information, please contact us at the address below to request deletion.

Sharing Personal Information

We share your Personal Information with service providers to help us provide our services and fulfill our contracts with you, as described above. For example:

  • We may share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.
  • We may share your Personal Information with ShipStation to purchase and print shipping labels to ship your orders.
  • We may share your Personal Information with logistics carriers such as the US Postal Service, UPS, and FedEx to complete your order.

Using Personal Information

We use your personal Information to provide our services to you, which includes: offering products for sale, processing payments, shipping and fulfillment of your order, contacting you for order-related issues, and keeping you up to date on new products, services, and offers.

Lawful basis

Pursuant to the General Data Protection Regulation (“GDPR”), if you are a resident of the European Economic Area (“EEA”), we process your personal information under the following lawful bases:

We do not engage in fully automated decision-making that has a legal or otherwise significant effect using customer data.

Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you.

Services that include elements of automated decision-making include:

  • Temporary denylist of IP addresses associated with repeated failed transactions. This denylist persists for a small number of hours.
  • Temporary denylist of credit cards associated with denylisted IP addresses. This denylist persists for a small number of days.
